Welcome to the website of Bar J Services LLC, doing business as Bar J Septic Services (“Bar J,” “we,” “us,” or “our”). By accessing or using our website located at https://www.barjservices.com/ (the “Website”), or by hiring us to provide services, you agree to be bound by these Terms and Conditions (“Terms”), our Privacy Policy, and any other policies we post on the Website.
Consent to receive text messages is separate, optional, and governed by Section 9 of these Terms. Accessing the Website, hiring Bar J, submitting an application, or accepting these Terms does not by itself constitute consent to receive text messages.
If you do not agree with these Terms, please do not use the Website or obtain our services.
1. Services
1.1 We provide septic system installation, septic pumping, site planning, and related services (collectively, the “Services”).
1.2 Use of the Website does not create a contract for Services. Any contract for Services will be governed by a separately executed service agreement or work order.
1.3 We reserve the right to refuse service or terminate a contract at our discretion, subject to applicable law and any written agreements between Bar J and the customer.
2. Use of the Website
2.1 You may use the Website only for lawful purposes and in accordance with these Terms.
2.2 You must not use the Website in any way that could damage, disable, overburden, or impair our infrastructure or interfere with another party’s use of the Website.
2.3 You agree not to attempt to gain unauthorized access to any part of the Website or our systems.
2.4 We may modify or discontinue the Website, or any part of it, without notice and without liability.
3. Intellectual Property
3.1 All content on the Website, including text, graphics, logos, images, audio, video, and software, is owned or licensed by us and is protected by applicable copyright, trademark, and other intellectual-property laws.
3.2 You may view, download, or print pages from the Website for your personal, noncommercial use, provided that you retain all copyright and other proprietary notices.

6. Payments and Refunds
6.1 Payment terms for Services will be set out in a separate service agreement or work order.
6.2 Unless otherwise agreed in writing, full payment is due upon completion of the Services.
6.3 Refunds, if any, will be at our sole discretion and may depend on the nature of the Services and the work completed.
7. Scheduling, Access, and Site Conditions
7.1 You must provide us with reasonable access to the site where Services will be performed, including access to necessary utilities, permits, approvals, and clearances.
7.2 If site conditions differ from those anticipated, including hidden obstructions, soil instability, inaccessible components, or other unforeseen conditions, additional costs or schedule adjustments may apply.
7.3 We are not responsible for delays or additional costs resulting from circumstances beyond our reasonable control, including weather, supply-chain disruptions, unforeseen site conditions, permitting delays, or changes requested by the customer.
8. Compliance and Permits
8.1 You are responsible for obtaining required permits, approvals, or inspections unless otherwise agreed in writing. Bar J may prepare and submit completed permit applications when included in the agreed scope of work.
8.2 We will comply with applicable laws, regulations, and industry standards when providing the Services. We cannot guarantee against future regulatory changes, changes in enforcement, or unforeseen legal or regulatory requirements.
9. Privacy, Data Protection, and SMS Messaging
9.1 Privacy and Personal Information
We collect, store, use, and process personal information as described in our Privacy Policy.
By using the Website or engaging our Services, you acknowledge the collection and use of personal information as described in the Privacy Policy. This acknowledgment does not constitute consent to receive text messages.
9.2 Optional SMS Messaging Programs
Bar J offers optional text-message programs for customers and employment candidates.
Participation in an SMS program is voluntary. Consent to receive text messages is not required to purchase services, obtain an estimate, submit an employment application, or be considered for employment.
Providing a telephone number alone does not constitute consent to receive automated text messages. Recipients will only be enrolled after providing express consent through an approved opt-in method.
9.3 Customer Service Messages
Customers who opt in may receive text messages related to:
- Service inquiries and requested estimates
- Scheduling and appointment confirmations
- Appointment reminders
- Technician dispatch and arrival updates
- Service delays or schedule changes
- Billing and payment notifications
- Service progress and job-completion updates
- Requested documents or information
- Customer-service follow-up
- Job-completion or customer-satisfaction surveys
- Other communications directly related to Services requested from Bar J
Customer consent may be collected through a separate optional Website checkbox, a written form, an in-person interaction, or a telephone call initiated by the customer.
When verbal consent is collected, the customer will be informed of the types of messages they may receive, that message frequency varies, that message and data rates may apply, and that they may reply STOP to unsubscribe or HELP for assistance.
9.4 Employment and Recruiting Messages
Employment candidates who separately opt in may receive text messages related to:
- Confirmation that an application was received
- Application-status updates
- Screening conversations
- Interview invitations and scheduling
- Interview confirmations and reminders
- Rescheduling or location information
- Job-related assessments
- Requests for employment-related information or documents
- Reference-check coordination
- Hiring-process updates
- Offer-related communications
- Candidate questions and replies
- Preboarding or onboarding information after an offer is accepted
Recruiting consent may be collected through a separate, optional, unchecked checkbox on a Bar J application or recruiting form, or through another documented opt-in method.
Consent to receive recruiting text messages is not required to apply for employment or to be considered for a position. Candidates who do not consent to text messaging may still receive recruiting communications through telephone calls, email, or other appropriate methods.
9.5 Message Frequency and Charges
Message frequency varies depending on the recipient’s service activity, application activity, and interactions with Bar J.
Message and data rates may apply according to the recipient’s mobile-service plan. Bar J does not charge recipients separately for participating in its SMS programs.
9.6 Opting Out
Recipients may unsubscribe from Bar J text messages at any time by replying STOP to the number from which the message was received.
After receiving an opt-out request, Bar J or its messaging provider may send one final confirmation message. No additional messages will be sent through that SMS program unless the recipient provides valid consent to opt in again.
An SMS opt-out does not prevent Bar J from communicating through non-SMS methods when reasonably necessary to provide requested Services, respond to an inquiry, administer an employment application, or satisfy a legal or contractual obligation.
9.7 Help and Customer Support
For SMS assistance, reply HELP to the number from which the message was received.

9.8 Supported Carriers and Delivery
Wireless carriers are not liable for delayed or undelivered messages.
Message delivery is subject to effective transmission by the recipient’s wireless carrier and is outside Bar J’s complete control. Availability may vary by carrier, device, service area, and mobile plan.
9.9 Mobile Information and SMS Consent
Bar J will not sell, rent, or share mobile telephone numbers, SMS opt-in information, or SMS consent information with third parties or affiliates for marketing or promotional purposes.
Bar J may provide limited information to service providers acting on Bar J’s behalf, including communications, software, scheduling, recruiting, customer-management, and automation providers, solely as necessary to operate and support Bar J’s messaging programs. These providers are not authorized to use the information for their own marketing or promotional purposes.
SMS consent is specific to Bar J and will not be transferred to another business for that business’s independent marketing or promotional use.

9.10 Changes to an SMS Program
Bar J may modify, suspend, or discontinue an SMS program at any time. Changes will not remove a recipient’s right to opt out or authorize messages beyond the scope of the consent provided.
10. Third-Party Links and Resources
10.1 The Website may contain links to third-party websites or resources. We do not endorse or assume responsibility for those websites or for their content, products, services, privacy practices, or availability.
10.2 Your use of third-party websites is at your own risk and is subject to the terms and policies of those websites.
11. Indemnification
You agree to defend, indemnify, and hold harmless Bar J Services LLC and its officers, directors, employees, and agents from and against claims, liabilities, losses, damages, costs, or expenses, including reasonable attorneys’ fees, arising from your breach of these Terms, your User Content, or your unlawful use of the Website or Services.
12. Termination
We may terminate or suspend access to the Website or terminate a Service contract as permitted by applicable law and the governing service agreement, including because of a violation of these Terms.
Sections that by their nature should survive termination, including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification, will continue to apply.
13. Governing Law and Dispute Resolution
13.1 These Terms and your use of the Website and Services are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles.
13.2 Any dispute arising out of or relating to these Terms, the Website, or the Services shall be resolved exclusively in the state or federal courts located in Randall County, Texas. You agree to submit to the personal jurisdiction of those courts.
14. Changes to These Terms
We may revise these Terms by posting an updated version on the Website. The effective date at the top will identify when the latest version became effective.
Changes to these Terms do not constitute SMS consent and do not expand the scope of any SMS consent previously provided.
Your continued access to the Website or use of our Services after changes are posted constitutes acceptance of the revised Terms, except where additional affirmative consent is required by law.
15. Miscellaneous
15.1 If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force.
15.2 These Terms constitute the entire agreement between you and Bar J regarding the Website and supersede prior or contemporaneous communications concerning the Website. Separate service agreements, work orders, employment documents, and other written agreements may govern their respective subject matters.
15.3 A waiver of any term or condition must be in writing and signed by Bar J.
